Hollywood Studios Take Torrent Website to Court

The way the internet and mainstream media work together is almost a symbiotic relationship. Most people opt to illegally download a movie from home, rather than pay to watch it in the theatre. While the movie gets the coveted popularity, the studio fails to see any of the profits. The explosion of torrent indexers and pirated streaming websites have created a huge obstacle for music labels and film studios. These websites make it difficult for them to earn the profits they need for major budget projects. The main issue here is copyright infringement, also known as stolen intellectual property. For this reason, several of Hollywood's biggest studios are aiming to win millions of dollars in damages from IsoHunt, a popular torrent based website. The trial date is set for November 5th, 2013.

The studios have successfully established the copyright liability of the website and now must prove how much monetary loss they have suffered from it. To be awarded damages, they have to show they owned the intellectual property that was illegally downloaded by at least one American user through the defendant's website. At this point, the studio has an overwhelming amount of incriminating evidence. The main focus of the trial is now based around on how much money will actually be awarded to the studios. Columbia Pictures led the charge against the torrent based website, submitting around 44 infringed works as evidence. Eventually, the studios are trying to submit close to 5,000 works in evidence against IsoHunt.

With a lawsuit like this, the studios could be compensated anywhere between $3.75 million and $750 million. While this seems like an unreasonable amount, it can cost up to $200 million to make just one motion picture. This means the studios are operating with high budgets and high risks, especially if their movies are illegally downloaded for no profit. This type of intellectual property litigation may affect the future of torrent based sites and their increasing popularity. Despite the number of lawsuits and actions against free content sites, many individuals still use them. The easy access to free movies and music has drawn millions of users, creating a serious challenge for entertainment workers.
