Fox vs. Dish Network Corp in a Breach of Contract Trial

News has been released that the well-known Fox Broadcasting Company is now filing for a ban on actions that are currently in process by the Dish Network Corporation. The Dish Network allows for viewers watching television to fast-forward over the commercials. Back in May, Fox, along with other broadcasting companies, filed a lawsuit against Dish claiming that their features to let people skip over commercials on recorded programs violated their contracts and oversteps their contracts with other companies.

Fox again last week filed the same lawsuit against Dish specifically against the ability Dish users have to record all prime time shows on the major networks (Fox, CBS, NBC, Comcast) and then watch any shows later that week completely commercial free. This claim addresses the major issue the networks could be facing if Dish continues to allow these features to continue. Fox claims that this will eventually lead to less people watching actual network television, and because of people not having to watch commercials, advertisers will be less likely to pay for a commercial slot. This breach of contract has been a huge concern for the broadcasting companies, not only because of the loss of revenue they will receive but also because it may also affect their ability in the future to borrow money as well.

This case will be determined in two separate hearings. First the copyright infringement hearings will be held in Los Angeles, and the breach of contract claims will be determined in New York in the future.
